Terms of service

Last updated: September 28, 2026

These Terms of Service ("Terms") govern your access to and use of demon-united.com and any related sites, content and services we operate (together, the "Site"), and your purchase of products from us. The Site is operated by Demon International LC, doing business as Demon United ("Demon United," "we," "us" or "our").

1. Agreement to These Terms

By visiting the Site, creating an account, or placing an order, you agree to these Terms and to the additional policies referenced in them, including our Privacy Policy, Shipping Policy, Refund Policy and Warranty Policy. Those policies are incorporated into these Terms by reference. If you do not agree to these Terms, do not use the Site or place an order.

If any policy referenced above conflicts with these Terms on a subject that policy specifically addresses — shipping timelines, return windows, warranty coverage — that policy controls on that subject.

2. Eligibility

You must be at least 18 years old to place an order or create an account. If you are under 18, you may use the Site only with the involvement of a parent or legal guardian, and any purchase must be made by that parent or guardian, who accepts these Terms on your behalf and is responsible for the order.

You may use the Site only where doing so is lawful. You are responsible for determining whether the products you order may lawfully be imported into and used in your country.

3. Your Account

You do not need an account to shop, but if you create one you agree to provide accurate information and to keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Do not share your username or password. If you believe your account has been compromised, contact us immediately at cs@demonunited.com.

We may suspend or close an account that we reasonably believe has been used fraudulently, to abuse our policies or promotions, or in violation of these Terms.

4. Products, Descriptions and Availability

We work to describe our products accurately, including sizing, materials, impact-protection certifications and intended use. Even so, product descriptions, images and specifications may contain errors, and colors may appear differently on your screen than in person. We do not warrant that descriptions or other content on the Site are error-free, complete or current.

Products are offered subject to availability. We may limit quantities, restrict sales to any person, region or jurisdiction, and discontinue any product at any time.

Certifications and standards referenced on a product page (for example EN or ASTM standards) apply to that product as manufactured and in unmodified condition. Modifying a product, or using it outside its intended application, voids any such certification and any warranty.

5. Pricing and Errors

All prices are shown in the currency selected at checkout and are subject to change without notice. Promotional pricing, discount codes and free-shipping thresholds apply as stated at the time of the offer; free-shipping thresholds are calculated on your order total after discounts are applied.

Despite our efforts, a product may occasionally be listed at an incorrect price or with incorrect information. If a product's correct price is higher than the price shown, we may, before shipping, either contact you for instructions or cancel the order and notify you. We are not obligated to honor an order placed at an obviously incorrect price.

6. Orders, Payment and Acceptance

Your order is an offer to buy. We accept your offer when we ship the product; an order confirmation email acknowledges receipt of your order but does not by itself constitute acceptance.

We may refuse, limit or cancel any order — including orders that appear to be placed by dealers or resellers, orders that fail address or payment verification, and orders that appear fraudulent. If we cancel an order after you have been charged, we will issue a refund to the original payment method.

You represent that you are authorized to use the payment method you provide and that the billing information you give us is accurate. Applicable taxes are calculated and shown at checkout.

Pre-order and backorder items ship on the date shown on the product page. Those dates are estimates based on supplier timelines and may move; if a date moves materially we will notify you, and you may cancel a pre-order for a full refund at any time before it ships.

7. Shipping and Delivery

Our Shipping Policy governs processing times, shipping methods, rates and delivery estimates, and forms part of these Terms. In summary, and subject to that policy:

  • All stated times are business days and exclude weekends and holidays. Delivery estimates are estimates, not guarantees.
  • Expedited methods have same-day cutoffs and do not deliver on weekends.
  • Risk of loss passes to you when we deliver the package to the carrier. We are not responsible for packages that are lost, stolen or delivered to an address you entered incorrectly, and claims against the carrier are yours to file.
  • An order returned to us as undeliverable, unclaimed or incorrectly addressed requires payment of reshipment costs. If you request a refund instead, shipping costs are not refunded.

International orders, duties and taxes

We ship to most countries. For most international destinations, duties and import taxes are calculated and collected at checkout through Shopify Managed Markets, so the amount you pay at checkout is your landed cost and no further customs charges should be due on delivery (Delivered Duty Paid). Where prepaid duties are not available at checkout, standard import charges may apply on arrival and remain your responsibility.

Import laws, tariffs and customs practices vary by country and are sometimes applied inconsistently by individual customs offices. We make no representation that our products may lawfully be imported into your country, and it is your responsibility to determine that before ordering. We cannot control or guarantee transit times once a shipment reaches your country's customs authority.

If a shipment is refused entry by customs, our refund policy applies: we will refund the purchase price, less shipping, handling and any duties or return import fees we incur, once the product is returned to us.

8. Returns, Exchanges and Refunds

Returns and exchanges are governed by our Refund Policy, which forms part of these Terms and controls in the event of any conflict with this section. In summary:

  • Unused gear may be returned within the window stated in that policy for a refund, less shipping, handling and any return import fees or duties we incur. You are responsible for return shipping.
  • Returns outside that window are accepted at our discretion and are subject to a restocking fee.
  • Gear must be returned with original packaging and tags; returns without them, or with damaged packaging, are subject to a restocking fee.
  • Items marked closeout or final sale are not eligible for return or exchange.
  • Used gear is accepted only for approved warranty claims.
  • Refunds are issued to the original payment method and typically post within 4–10 business days of processing, depending on your bank.

9. Warranty

Products are covered by the warranty described in our Warranty Policy. That warranty covers defects in materials and workmanship under normal use, for the period and on the terms stated there.

The warranty does not cover normal wear, cosmetic damage, damage from impact or crash, damage from improper use, modification, improper care or storage, or products purchased from an unauthorized reseller. Except as expressly stated in the Warranty Policy, and except for warranties that cannot be disclaimed under applicable law, we make no warranties of any kind — see section 16.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain remedies, and nothing in these Terms limits any non-waivable statutory right you have as a consumer where you live.

10. Protective Gear: Assumption of Risk and Proper Use

Please read this section carefully. It concerns the safe use of our products and limits our liability.

Snowboarding, skiing, mountain biking, BMX, skating and similar activities are inherently dangerous. They carry a risk of serious injury, permanent disability and death. No protective equipment eliminates that risk.

Our products are designed to reduce the severity of certain impacts. They cannot prevent all injuries, and they cannot protect against every type or force of impact. Wearing our products does not make an activity safe and should not encourage you to ride, ski or skate beyond your ability. By purchasing and using our products, you acknowledge and voluntarily assume the risks inherent in these activities.

You agree that:

  • Fit matters. Protective equipment performs as designed only when it is the correct size and is worn, positioned and fastened as instructed. Consult our size and fit guide and the instructions supplied with the product, and do not use a product that does not fit properly.
  • Follow the instructions. Use, care, cleaning and storage instructions supplied with a product, or published on the Site, are part of its intended use.
  • Inspect before every use. Do not use a product that shows cracks, deformation, torn stitching, degraded foam or padding, damaged straps or fasteners, or any other damage or excessive wear.
  • Replace after an impact. Helmets and impact-absorbing protection are designed to manage energy and may be compromised by a significant impact even when no damage is visible. Replace any helmet or impact protection that has taken a significant impact, and replace products at the end of any service life stated for them.
  • Do not modify. Painting, drilling, cutting, applying solvents or adhesives, removing components, or altering a product in any way may compromise its protective performance and voids all certifications and warranties.
  • Use as intended. Each product is designed for the activities described on its product page. Using it for another purpose — including any motorsport or motorcycle use unless the product page states otherwise — is outside its intended use.

Certain products may contain chemicals subject to California Proposition 65 warnings; see our Prop 65 page.

11. Privacy

How we collect, use and disclose personal information is described in our Privacy Policy, which forms part of these Terms. Our store is hosted by Shopify, and Shopify processes data about your visit and your purchases in order to provide services to us and to you, including services that draw on your interactions with other merchants and with Shopify. Our Privacy Policy describes this and your choices, including how to opt out of the sale or sharing of your personal information where that right applies to you.

12. Intellectual Property

The Site and its contents — including the Demon and Demon United names and logos, product names, photographs, video, graphics, copy, and the selection and arrangement of all of it — are owned by Demon International LC or our licensors and are protected by copyright, trademark and other laws. D3O and other third-party marks appearing on the Site are the property of their respective owners.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your own personal, non-commercial purposes. You may not copy, reproduce, republish, scrape, distribute, sell, or create derivative works from any part of the Site, or use our marks, product images or copy in connection with any product or service, without our prior written permission. Authorized dealers and media partners may use assets we supply, on the terms we provide with them.

If you believe content on the Site infringes your copyright, contact us at cs@demonunited.com with enough detail to identify the work and the allegedly infringing material.

13. Your Content and #DEMONSAVES Submissions

If you submit, post, tag or send us photos, video, reviews, comments or other content — including footage you share with us or tag with #DEMONSAVES or @demonunited — you grant Demon International LC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable and transferable license to use, reproduce, edit, adapt, publish, distribute and display that content in any media, for marketing and any other business purpose, with or without attribution and without compensation to you.

You represent that you own or control all rights in the content you submit, that you have the consent of everyone appearing in it (and of a parent or guardian for anyone under 18), and that the content does not infringe anyone's rights or violate any law. We are not obligated to use, publish or retain any submission, and we may remove or stop using content at any time.

14. Prohibited Uses

You agree not to use the Site to: violate any law or regulation; infringe any intellectual property or privacy right; submit false or misleading information; upload viruses or other malicious code; scrape, crawl, harvest or otherwise extract data by automated means except as permitted by our robots.txt; interfere with or circumvent the security or proper functioning of the Site; harass, abuse or harm another person; impersonate any person or entity; or purchase products for resale without our written authorization. We may terminate your access for violating this section.

15. Third-Party Links and Services

The Site links to and relies on services operated by third parties, including our returns portal, payment processors and social platforms. We do not control those services and are not responsible for their content, products, policies or practices. Your dealings with a third party are between you and that third party, and their terms and privacy policies govern.

16. Disclaimer of Warranties

Except for the express warranty described in our Warranty Policy, and except for warranties that cannot be excluded under applicable law, the Site and all products, content, materials and services made available on or through it are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the Site will be uninterrupted, secure or error-free, that defects will be corrected, that the Site or the servers that make it available are free of viruses or other harmful components, or that the content on the Site is accurate, complete or reliable. If you are dissatisfied with the Site, your sole remedy is to stop using it.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

17. Limitation of Liability

To the fullest extent permitted by law, Demon International LC and its parent, subsidiaries, affiliates, officers, employees, agents, suppliers and content providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost business or loss of data, arising out of or related to these Terms, the Site, or any product purchased from us, whether based in contract, tort (including negligence), strict liability or any other theory, and even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to these Terms, the Site or a product will not exceed the greater of the amount you paid for the product giving rise to the claim, or fifty U.S. dollars (US$50).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under any non-waivable consumer protection or product liability law. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some of the above may not apply to you, and nothing here affects your statutory rights as a consumer.

18. Indemnification

You agree to indemnify, defend and hold harmless Demon International LC and its parent, subsidiaries, affiliates, officers, employees and agents from any claim, demand, loss, liability, damage, cost or expense, including reasonable attorneys' fees, arising out of your breach of these Terms or any policy incorporated into them, your violation of any law or the rights of a third party, your misuse of any product, or content you submit to us.

19. Governing Law and Disputes

These Terms and any dispute arising out of or relating to them, the Site or a product are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. You and we agree that the state and federal courts located in Utah County, Utah have exclusive jurisdiction and venue over any such dispute, and you consent to personal jurisdiction there.

If you are a consumer resident in the European Economic Area, the United Kingdom or another jurisdiction whose law gives you the right to bring proceedings in your local courts or the protection of mandatory local consumer law, nothing in this section deprives you of that right.

Before filing a claim, please contact us at cs@demonunited.com so we can try to resolve it directly. Most issues are resolved this way.

20. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, our products or the law. The revised version takes effect when posted on this page, and we will update the "Last updated" date above. Your continued use of the Site after that date means you accept the revised Terms. The version in effect when you place an order governs that order.

21. General

Entire agreement. These Terms, together with the policies they incorporate, are the entire agreement between you and us regarding the Site and your purchases, and supersede any prior agreements or understandings.

Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of that provision or of any other.

Assignment. You may not assign these Terms without our written consent. We may assign them, including in connection with a merger, acquisition or sale of assets.

Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, labor disputes, carrier delays, supply chain disruption, war, or government action.

Headings. Section headings are for convenience only and do not affect interpretation.
